CNN has reported that Chief U.S. District Judge Vaughn Walker overturned Proposition 8, which banned gay marriage in California.
In a 136-page decision, Judge Walker declared Prop 8 unconstitutional:
Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed the evidence shows Proposition 8 does nothing more than enshrine in the California constitution the notion that opposite sex couples are superior to same sex couples.
Before the decision was released, lawyers for the opposing side filed a motion to stay his appeal, so we can probably expect to see this end up in Supreme Court.
