(PCM) The news is breaking that Brendan Dassey, nephew of Steven Avery, who was convicted of assisting his uncle with the murder of Teresa Halbach has been ordered to be released from prison immediately. The case was the subject of the highly debated Netflix documentary series “Making A Murderer”. Many felt that Dassey was unfairly interrogated by the detectives investigating the case and he was coerced into making a false confession.
A federal judge reviewed the case and reached the decision that Dassey’s constitutional rights were violated during the interrogation by detectives which took place without a lawyer or his parent present. According to TMZ.com, who broke the story, the judge said authorities exacerbated the problem by assuring Dassey they were on his side. The judge also added, “Dassey’s borderline to below average intellectual ability likely made him more susceptible to coercive pressures than a peer of higher intellect.”
Prosecutors in the state of Wisconsin have a period of 90 days to make a decision as to whether or not they would like to retry Dassey for the murder of Teresa Halbach . A TMZ representative spoke with the Wisconsin Attorney Generals office and they commented that they had not yet reached a decision about whether or not they will refile charges against Dassey and are currently reviewing the judges decision/order for his release.
